Talk of the Town: Prize Package Competition Terms and Conditions

TERMS AND CONDITIONS 

  1. THE PROMOTER 

Be the Business Trading Limited, a company registered in England and Wales with company number 10894488 (“Promoter”). 

  1. HOW TO ENTER 

2.1 The competition will run from midnight (GMT) on 7 April 2024 (the "Opening Date") to midnight (GMT) on 13 May 2024 (the "Closing Date") inclusive. 

 

2.2 No purchase is necessary and there is no charge for entering. 

2.3 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind 

2.4 By submitting a registration form, you agree to be bound by these terms and conditions 

2.5 The competition winners will be determined by the Promoter.  

  1. ELIGIBILITY 

3.1 To enter the competition you must complete a registration form before the Closing Date and be an eligible business with a base in 1 of the following 8 towns: Weston-Super-Mare, Armagh, Boscombe, Northwich, Shrewsbury, Waltham Cross, Altrincham, Sherborne. 

3.2 Your business must have a minimum of 3 employees and must have been trading for at least 1 year (as at the Opening Date) 

3.3 By entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof of your eligibility. 

3.4 Only senior decision-makers of the business may claim the prize and attend the webinar or participate in the Productivity Programme, for example managing director, owner-manager, or chief executive. 

3.5 The Promoter will not accept competition entries that are: 

  1. automatically generated by computer; 

  1. completed by third parties or in bulk; or 

  1. incomplete 

3.6 There is a limit of one entry per business. Entries on behalf of another business will not be accepted and joint submissions are not allowed. 

3.7 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition. 

4. PRIZE 

4.1 The prize is sponsorship of up to 80 attendees at an online webinar and/or sponsorship of 8 Productivity Programme places as prizes for business competition winners. Only 1 place at the webinar and/or the Productivity Programme may be claimed per business. 

4.2 Prizes are subject to availability. There is no cash alternative for the prize. 

4.3 The prizes are non-negotiable and non-transferable 

4.4 In order to claim the prize you must meet the eligibility criteria above and submit a registration form by the Close Date.  

5. CLAIMING THE PRIZE 

 

5.1 The Promoter will notify winning entrants by 17 May 2024 (the “Announcement Date”). 

5.2 The Promoter will contact the winners personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will also publish the winners online including its website and its social media accounts.  

5.3 The Promoter’s decision is final and no correspondence or discussion will be entered into. 

5.4 If you do not wish for your name, company name, or town to be published, please contact the Promoter at enquiries@bethebusiness.com. In such circumstances, the Promoter may still need to provide information relating to you to the Advertising Standards Authority on request.  

5.5 The prize may not be claimed by a third party on your behalf 

5.6 The Promoter will make reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within seven days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date. 

5.7 The Promoter accepts no liability or responsibility if you are not able to take up the prize. 

6. LIMITATION OF LIABILITY 

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. 

7. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS 

7.1 The Promoter does not claim any rights of ownership in your competition entry. 

7.2 You agree that the Promoter and its partners reserve the right to make your entry available on their respective websites and social media accounts, whether now known or invented in the future, and in connection with any publicity and marketing campaigns from time to time. You agree to grant the Promoter and its partners a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes. 

8. DATA PROTECTION AND PUBLICITY 

The Promoter will only process your personal information as set out in its privacy policy and in accordance with section 5 of these terms. 

9. GENERAL 

9.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition. 

9.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. 

9.3 These terms and conditions shall be governed by English law, and you submit to the exclusive jurisdiction of the courts of England and Wales.
